WHEN DO WE PROCESS WHICH PERSONAL DATA?
We process your personal data in the following cases:

a. When you visit our website, the browser you use on your device automatically sends information to the server of our website. This information is temporarily stored in a log file. The following information is recorded without you having to take any action and stored until it is automatically deleted:

  • IP address of the computer sending the query,
  • Date and time of access,
  • Name and URL of the accessed file,
  • Website from which our website was accessed (referrer URL),
  • Browser used and operating system of your computer, if applicable, as well as the name of your access provider.

b. You can contact us through the form on our website should you have any questions for us. When doing so, you have to enter a valid email address to tell us who the enquiring person is and to enable us to respond to you. You can enter additional information on a voluntary basis.

c. If you are interested in our emsys Solar Box solar system controller, you can contact us at any time through the form on our website. To do so, you have to enter the relevant details so that we can provide you with a tailored offer.

d. If you wish to send us your CV to apply for an advertised position or for an unsolicited application, we process the documents and personal data you have provided for this purpose. We require your name, address and other contact details, date and place of birth, nationality and qualification documents for processing your (unsolicited) application. You can also provide us with optional information that you believe would increase the success of your application.

e. Registered customers and operators can access additional information relating to the products used on our website. The registration process is completed by us or your customer. The data used as part of this registration (user name / one-off password) is collected and stored exclusively for the use of our website. When you register on our website, your IP address and date and time of your registration are also stored.

PURPOSES OF THE DATA PROCESSING ACTIVITIES
We only use the personal data you actively provide to us for the respective agreed purpose and only within the required scope.

a. We process the above data for the following purposes:

  • Ensuring that a smooth connection is created to our website,
  • Ensuring that our website is easy to use,
  • Analysing system security and stability, and
  • For other administrative purposes.

Art. 6 (1) sentence 1 lit. f of the General Data Protection Regulation (GDPR) forms the basis for the data processing activities. Our legitimate interest is based on the data collection purposes stated above. We never use the collected data for drawing conclusions regarding your person.

b. The data used for contacting us is processed in accordance with Art. 6 (1) sentence 1 lit. b GDPR on the basis of a pre-contractual measure. If a contract is concluded, the data may be included in our customer service system. The data is not processed for any other purposes.

c. The data used for requesting an offer from us is processed in accordance with Art. 6 (1) sentence 1 lit. b GDPR on the basis of a pre-contractual measure. If a contract is concluded, the data may be included in our customer service system. The data is not used for any other purposes.

d. The data is processed for the purpose of concluding and fulfilling an employment contract in accordance with Art. 88 GDPR in conjunction with Section 26 of the German Data protection Act (Bundesdatenschutzgesetz – BDSG). If your job application is successful, your personal data is entered in our HR file for employee management purposes.

e. If you are registered with us, we use your data for managing your account and as a security for us in the event of a third party misusing your data and registering on our website with this data without your knowledge in accordance with Art. 6 (1) sentence 1 lit. b GDPR.

PERSONAL DATA RECIPIENT CATEGORIES
Your personal data is never transferred to third parties for any other purposes than those stated below.

We only transfer your personal data to third parties if:

  • You have given your explicit consent for us to do so in accordance with Art. 6 (1) sentence 1 lit. a GDPR.
  • The transfer is necessary in accordance with Art. 6 (1) sentence 1 lit. f GDPR in order to assert, exercise or defend against legal claims and there is no reason to assume that you have an overriding legitimate interest in non-disclosure of your data,
  • It is obligatory by law to transfer the data in accordance with Art. 6 (1) sentence 1 lit. c GDPR, and
  • This is legally permissible and required for processing contractual relationships with you in accordance with Art. 6 (1) sentence 1 lit. b.

Data is only transferred to third countries if you have given us your consent to do so.

PERSONAL DATA STORAGE PERIOD
a) Cookies are stored as session cookies in your browser, meaning that your browser automatically deletes them again when you leave our website. In this case, the data is stored for the period required to ensure the technical functionality of your browser.

b) Personal data transferred to us in connection with a contact query on our website is only stored for as long as the query is being processed. If a contract is concluded, the data provided by you may legally be stored in our customer service system for a period of 10 years, unless there is another legal obligation which requires us to store it for longer.

c) Personal data entered on our website in connection with the provision of an offer is only stored for as long as the query is being processed. If a contract is concluded, the data provided by you may legally be stored in our customer service system for a period of 10 years, unless there is another legal obligation which requires us to store it for longer.

d) The collected personal data is stored for the following period:

  • a. Unsuccessful application: For a minimum of three months. The maximum storage period is six months.
  • b. Successful application: Our storage periods apply. The information to which you are entitled is provided to you upon successful application.

e) The personal data you have provided is stored until you revoke your consent for us to do so.

f) Personal data transferred to us in connection with a registration on our website is only stored for as long as the account is active. If a contract is concluded, the data provided by you may legally be stored in our customer service system for a period of 10 years, unless there is another legal obligation which requires us to store it for longer.

Please note that we delete your data if its storage is impermissible (particularly if the data is inaccurate and it is impossible to correct it). The data is blocked instead of deleted if it cannot be deleted for legal or actual reasons (e.g. obligatory retention periods specified in trade and tax law).

RIGHT TO OBJECTION
If your personal data is processed on the basis of legitimate interests in accordance with Article 6 (1) Sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR provided that there are reasons for this which arise from your particular situation or the objection refers to direct advertising. In the event of the latter, you have a general right to objection which is implemented by us without having to state any specific situation.

PROVISION OF PERSONAL DATA

AUTOMATIC DECISION-MAKING PROCESS INCLUDING PROFILINGAn automatic profile of you may be created for the purpose of analysing personal aspects. We use such profiling measures in the following cases:

In accordance with legal and regulatory requirements, we are obliged to combat money laundering activities, the financing of terrorism and crimes which are damaging to assets. We also analyse data in this respect (including comparisons with legally specified lists).

MATOMO
We use methods for measuring the statistical reach of our website. These include information such as the user's length of stay, device used, operating system, language settings, origin, region, location or user actions.
We collect the above information through a cookie which is installed on your device. Your IP address is anonymised before being stored. We operate the website and Matomo on our own systems and the data is therefore not transferred to third parties.

The cookie installed on your device is stored for seven days.
The statistical analyses of the data of the anonymous users are deleted after six months.

We call on Art. 6 (1) lit. f GDPR as the basis for the processing. We therefore claim a legitimate interest in the analysis, optimisation and economical operation of our website and therefore mitigate the impairment of your personal rights through a preset. You further have the right to object to the processing at any time and with future effect. When raising an objection, a cookie is automatically stored on your device which stops the analyses from being performed. If you delete all cookies at a later date, tracking will automatically be activated again at your next visit as the opt-out cookie has also been deleted.

SOCIAL PLUGINS
We provide you with the option to use social media buttons on our website. We use the "Shariff" solution on our website for protecting your data. This ensures that the buttons are merely integrated as graphics containing a link to the corresponding website of the button provider on our website. You are therefore forwarded to the respective provider after clicking on the graphic. Your data is only transferred to the respective provider at this point. If you do not click on the graphics, no data exchange commences between you and providers of the social media buttons. INTEGRATION OF YOUTUBE VIDEOS
We have integrated videos from the YouTube platform by Google Ireland Limited, Gordon House, Barrow Street, Dublin, Ireland, in our website. These are stored on www.youtube.com and can be played directly from our website. We have no influence over this data transfer.

By visiting the website, YouTube receives the information that you have accessed the corresponding sub-page on our website. This information is transferred regardless of YouTube providing a user account through which you are logged in or not. If you are logged into Google, you data is linked directly to your account. If you do not wish for your data to be linked to your YouTube profile, you must log out before activating the button. YouTube stores your data as a user profile and uses it for advertising purposes, market research and/or the needs-based design of its website. The data is analysed, in particular (even for users who are not logged in), for displaying needs-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of such user profiles. However, you have to contact YouTube to exercise this right.

OPENSTREETMAP
We use the map service of OpenStreetMap (OSM). The provider is the Open-Street-Map Foundation (OSMF), 132 Maney Hill Road, Sutton Coldfield, West Midlands, B72 1JU, United Kingdom.

When you visit a website on which OpenStreetMap is embedded, your IP address and other information about your behavior on this website is forwarded to OSMF, among other things. OpenStreetMap may store cookies in your browser or use similar recognition technologies to do this.

DATA SECURITY
We use the common SSL (secure socket layer) method in connection with the highest encryption standard supported by your browser when you visit our website. This generally is 256 bit encryption. If your browser does not support 256 bit encryption, we use 128 bit v3 technology instead. You can see if an individual page on our website is transferred in an encrypted format by the closed key or lock symbol displayed in the bottom status bar of your browser.
